Low transaction charges don’t promote digital payments: Mastercard CEO Ajay Banga

MUMBAI: The opportunity to grow digital payments in India is enormous, with just about 10% of the total merchant community in the network, but tinkering with fees associated with electronic transactions could slow the adoption rather than promoting it, said Mastercard CEO Ajay Banga.There is no empirical evidence that either a low merchant discount rate (MDR) or the absence of it promotes digital transactions. On the contrary, any such move takes away the incentive for intermediaries, who are vital for acquiring customers, Banga said in a telephonic interview. He was speaking to ET two days after the announcement that he would be elevated to the position of executive chairman.MDR is the fee charged by banks and payments companies from merchants or shop owners for providing them payment settlement infrastructure, or point-of-sale (PoS) machines.“Wherever in the world MDR has been reduced to the levels where it makes it uneconomical for the acquirer or issuer to participate in the natural business of electronic payments, you tend to lose the momentum. It’s a balancing act,” he said.The government has been tinkering with the fee paid for electronic transactions using debit cards. Recently, it scrapped MDR charges on payments made using the RuPay card, which is issued by the National Payments Corp of India.Low MDR charges take away the incentive that is essential for companies that get customers on board. These companies then do not find it meaningful to remain in business, Banga pointed out.“We need to find a way to ensure economic sustenance for this model,” he said. “My view is that commercial sustainability in these decisions is very important. There are a lot of studies to show that this is the right way to think about it.”Banga said there is an immense opportunity to promote digital payments in India with just about 5 million of the total 65 million merchants currently in the network, he said.“Don’t know the right number (cash to digital) for India, but I do expect digital payments in India to grow substantially than (in) the past 10 years,” Banga said. “About 5-6 million merchants accept card payments in India, which is way more than what it used to be four years ago when just 1 million merchants accepted cards. But the scope is huge. There are nearly 65 million merchants in India.”Banga also praised the banking regulator for proactively pushing digital payments and being receptive to suggestions.“I think the RBI (Reserve Bank of India) has been very fair and transparent. I don’t have a lot of advice for them, it is one of the best regulators in the world,” he said.“We have been telling them (the RBI) our views on data predictability. Bengaluru: The commercial leasing activity is expected to continue its strong momentum across seven major cities over the next four year with IT/ITeS and flexible office space driving the demand.According to Colliers International, between 2020-24, the office space is expected to witness average annual gross absorption of 5.1 million sq metres, outpacing the annual average gross absorption of the preceding five-year period by about 14%.“We expect Hyderabad to be among the top four office markets in India by 2024, led by expansion of technology companies, and global in-house centres,” said Megha Maan, senior associate director-research, Colliers International India. Hyderabad has risen to the second spot in gross office absorption in 2019.Colliers said, the new supply is also expected to reach a new peak during 2020-24 with average annual supply at about 5.9 million sq metres.“Over the past few years, we have been focusing on expanding our presence across India with upcoming developments in Mumbai, Pune, Ahmedabad, Delhi and Gurgaon. We are excited about strengthening our business in the new markets, while continuing to transform the Indian realty sector,” said Irfan Razack, CMD, Prestige Group.However, over 2020-24, the pan-India average rentals will slow at CAGR 1.1% owing to huge quantum of supply planned over the next five years. Coronavirus rumours hit sales of egg, chicken

NEW DELHI | KOCHI: Top poultry companies in the country said sales of chicken and eggs have halved over the last few weeks, driven down largely by rumours that linked them to the coronavirus infection.BS Yadav, managing director of Godrej Agrovet, a compound animal feed company, told reporters on Thursday that the rumour has led to a 50% drop in consumption to 35-40 million birds a week, while prices have dropped by 70%.According to Yadav, the company’s poultry arm, Godrej Tyson Foods, too, has taken a hit—earning from its chicken business has fallen by 10-11% during the period. Godrej Tyson Foods is a joint venture between Godrej Agrovet and Tyson Foods-USA. It sells 600,000 fresh and frozen chicken every week.“We see a short-term challenge due to the coronavirus scare which has led to a drop in consumption of chicken in the country,” Nadir Godrej, chairman of Godrej Agrovet, said, referring to Godrej Tyson Foods.According to Yadav, the company has seen a 30-40% drop in sales in its branded chicken business. “In the last four-five weeks, we have seen 10-11% loss on earning in our chicken business. It’s not only companies, but farmers too who are making losses for the past 3-4 weeks, with a surplus building up,” he said.

Vodafone Idea: DoT braces for the worst, weighs mobile number porting capacity

MUMBAI: Telecom department officials have asked India’s two mobile number portability (MNP) service providers on how many porting requests can they process in a day, as the government evaluates contingency options in the eventuality that Vodafone Idea doesn’t survive the adjusted gross revenue (AGR) crisis.Officials in the Department of Telecommunications (DoT) though say that the Plan A for the government is to make every effort to see that Vodafone Idea survives the present turmoil, and that India remains a three-private sector player market. On Friday, the Digital Communications Commission (DCC) – the highest decision-making body of the DoT – may discuss some steps on providing relief to stressed telcos such as Vodafone Idea.According to people aware of the developments, the government was informed that at the most 500,000 customers can be ported out each day on a combined basis by the two MNP providers—Syniverse Technologies India and MNP Interconnection Telecom Solutions India. Both companies did not respond to ET’s queries at the time of going to press.This capacity though may prove grossly inadequate to cater to over 300 million subscribers of Vodafone Idea, leading to severe service quality issues, as the potential recipients—Bharti Airtel and Reliance Jio—don’t have adequate capacity to immediately absorb the massive influx to their networks, say experts.74362580 A contingency plan in this case is a complex one since it will include how to ensure smooth port outs in bulks of thousands to the two remaining operators. “This will put tremendous strain on the systems. To handle bulk requests of so many million customers will be a big task and hence, a contingency plan needs to be in place,” said a person aware of the development. “Also, the telcos will have to discuss what are the charges acceptable to them to take in so many customers”.MNP refers to the facility allowing a user to switch telco operators without changing the mobile number. The recipient operator pays a fee to the MNP service provider for processing the request.“This will be a panic like situation… right now telcos are operating at 70-80% of network utilization. Without additional spectrum, despite all the spectrum farming (reusing 3G spectrum for 4G), splitting one-third subscriber market between two operators will be very difficult,” said SBICap Securities research head Rajiv Sharma.There have been reports that both rivals have started discussing on how to upgrade their network in case Vodafone Idea goes down. Jio has 370 million while Bharti Airtel has 283 million subscribers.Vodafone Idea has so far paid Rs 3,500 crore of the DoT’s estimated Rs 57,000 crore dues. The telco estimates its dues to be around Rs 23,000 crore. Experts say the cash-strapped carrier will find it difficult to pay even its own estimated dues in a short period of time.The telco has said it will be forced to shut down unless it gets some relief on its AGR dues. The government is considering, among others, setting up a stress fund for stressed telcos to draw from to pay off AGR dues and repay on easy terms, besides deferment of license fees and spectrum usage charge (SUC) for a substantial period to free up cash flows.On Wednesday, Vodafone Idea dispatched a letter to finance minister, DoT and Niti Ayog, calling on the government to allow it to pay AGR dues over 15 years, after a three-year moratorium. The telecom company has also asked for a tax refund to be adjusted against its dues, cuts in licence fees and SUC and the establishment of a floor for tariffs, among measures to help remain viable.The telco has also urged the DoT not to encash its bank guarantees against unpaid AGR dues, as that would force the telco to close down.Having already rejected a petition seeking review of its October 2019 order, which said AGR should include non-core items, the Supreme Court’s hearing of the modification on March 17, which is also the deadline for payment of dues, assumes critical importance.The telcos have asked in the modification pleas to be allowed to negotiate modalities and timelines for paying the AGR dues with the DoT.

NEW DELHI: Domestic rates of petrol and diesel, down about Rs 4 a litre since mid-January, are set to decline further as crude oil slumped to a 13-month low on Thursday to about $52/barrel on fears that the coronavirus outbreak may take a heavy toll on global economic growth and oil demand.Petrol is down Rs 3.74 a litre and diesel Rs 4.41 a litre since mid-January. In Delhi, petrol was priced at Rs 71.96 and diesel Rs 64.65 a litre on Thursday.State fuel retailers take 15-day moving average of international rates of fuels and factor in the exchange rate to calculate domestic prices of petrol and diesel daily. Fuel rates largely follow crude oil trajectory. Crude oil has tumbled 12% in eight days as several cases of coronavirus emerged from many countries. Oil is down a quarter since the beginning of the year.Falling oil prices are good for heavy energy consumer like India that imports 85% of its oil needs. Lower oil prices help keep inflation in check, reduce fuel subsidy, cut current account deficit and leave more resources in the hands of the state for public spending."For now, what we know for sure is that the month of February will record the worst oil demand contraction since the Great Recession. We also know that global aviation will be hit very hard across Asia and take months to get back in shape," S&P Global Platts Analytics said in a report. "In addition, we are aware that our best-case scenario-a V-shape recovery we last saw during the SARS-2003 outbreak-is already unachievable due to China's inability to go back to 'business as usual' at the beginning of February, and we project it will take another month for full normalisation."Coronavirus cases have jumped within and outside China. The US reported first such case while Germany, Italy, Japan, Korea, Greece and Iran reported a rise in such cases. Pakistan and Brazil too have detected such cases.Japan has ordered closure of all schools to stop the spread of virus while Saudi Arabia has halted religious visits. Governments and organisations have postponed several events while companies have begun warning of impact on earnings.Goldman Sachs has warned that US companies will generate no earnings growth in 2020 if coronavirus becomes widespread.

GDP growth in Q3 likely to stay flat at 4.5%: Economists

NEW DELHI: India’s economy is likely to have grown at the same pace as in the third quarter at 4.5%, most independent economists said, though others expect growth to be a tad faster, based on a slight pickup in agriculture and government spending.“Our composite leading indicator (index of 33 major leading indicators) suggests that gross domestic product growth to remain flat at 4.5% as in Q3 of FY20,” said Soumya Kanti Ghosh, group chief economic adviser, State Bank of India.India’s economic growth slipped to a 26-quarter low of 4.5% in July-September from 5% in the first quarter.The statistics office lowered the FY19 GDP growth rate to 6.1% from the provisional estimate of 6.8% and has forecast 5% growth in FY20, its slowest pace in 11 years. The Economic Survey 2020 sees a recovery to 6-6.5% in FY21. “We were earlier anticipating a downward revision in FY20 growth rate from 5% to 4.6%,” Ghosh said.This downward revision, as per Ghosh, will have statistical benefits as it could push up FY20 GDP to 4.7%. “There is not much improvement. We have retained our full year GDP target at 4.7%,” said Upasna Bhardwaj, economist at Kotak Mahindra Bank.Manufacturing activity is likely to remain pressured and unlikely to better the 6.4% growth in the corresponding period the year ago. Falling growth seen in sales of commercial vehicles, railway freight traffic and cargo handled by civil aviation has also contributed to the projection being significantly lower. “There is no joy in the GDP story. Consumption could be slightly better because of PM-KISAN but there is no systematic improvement anywhere,” said IDFC First Bank chief economist Indranil Pan. 74327430 The Reserve Bank of India has cut policy rates by 135 bps since February, 2019, and the government reduced corporate rate tax to 22% in order to attract investment and boost growth.Despite these steps, indicators available till the quarter ended December, 2019, are not particularly robust, said Madan Sabnavis, chief economist at CARE Ratings.“The sharp decline in October and November seems to have been reversed in December,” said Devendra Kumar Pant, chief economist at India Ratings.

Goods procured from SEZs by single brand retailers to qualify for meeting local sourcing norms

New Delhi: Goods procured from units in special economic zones (SEZ) by single brand retailers, owned by foreign companies, would qualify for meeting the mandatory 30% local sourcing norms, the government said in a clarification.The Department for Promotion of Industry and Internal Trade (DPIIT) said goods which are proposed to be sourced by a single brand retailer from SEZ units will have to be manufactured in India.As per the foreign direct investment (FDI) rules, 100% overseas investment is allowed in the sector but sourcing of 30% of the value of goods procured is mandatory from India for such companies having FDI beyond 51%.SEZs, developed as export hubs, are treated as foreign territory in terms of customs laws. Procurement of goods and services from units in these zones are treated as imports.“As regards sourcing of goods from units located in SEZs in India, it may be clarified that sourcing of goods from such units would qualify as sourcing from India for the purpose of 30% mandatory sourcing from India for proposals involving FDI beyond 51%, subject to SEZ Act, 2005,” the department said in the clarification.The statement came in the wake of the government having received representations from various business entities seeking clarification whether sourcing of goods from units located in SEZs would qualify as sourcing from India as per the FDI policy.The department stated that compliance with all the conditions enumerated in the FDI policy and as notified under the Foreign Exchange Management Act (FEMA) would continue to be the responsibility of the manufacturing entity.In January 2018, the government allowed 100% FDI in the sector, permitting foreign players in single brand retail trade to set up own shops in India without government approval.74327360 INSURANCE INTERMEDIARIESSeparately, the department on Tuesday notified the government's decision to allow 100% FDI in insurance intermediaries. Intermediary services include insurance brokers, re-insurance brokers, insurance consultants, corporate agents, third-party administrators, surveyors and loss assessors.In a press note, the DPIIT said 100% FDI is allowed in insurance intermediaries under the automatic approval route.The FDI policy earlier allowed 49% foreign investment in the insurance sector, which includes insurance intermediaries.As per the press note, the insurance intermediary that has majority share holding of foreign investors shall undertake measures including incorporation as a limited company under the provisions of the Companies Act 2013 and that at least one from among the chairman of the board of directors or the CEO or principal officer or MD of the company shall be a resident Indian citizen.It also said the intermediary shall take permission of the Insurance Regulatory and Development Authority (Irda) for repatriating dividend and not make payments to the foreign group or promoter or associate entities beyond what is necessary or permitted.

RBI's gradual shift from transparency to forbearance towards stressed sectors

In November 2013, the then central bank Governor Raghuram Rajan had warned banks against dressing up loans, likening the practice with “putting lipstick on a pig” (that) “will not make a princess.” His stance marked the beginning of the end of forbearance. Rajan’s successor Urjit Patel, too, continued with the tradition of nixing proposals that kicked the can down the road.But the new RBI regime under Shaktikanta Das has been different. It has already allowed banks to extend the MSME loan recast scheme and allowed restructuring of loans to the real estate sector.“The RBI announcement of forbearance towards stressed sectors signifies a gradual shift away from the regulator’s earlier efforts to enhance the quality and transparency of asset classification in the Indian banking system,” said Saswata Guha, director, financial institutions, Fitch Ratings. “There is a risk that such regulatory forbearance will perpetuate moral hazard, as it follows aggressive lending growth and risk-taking in certain sectors.”Indian banks have a poor track record with restructuring. The RBI’s asset quality reviews in FY16 and FY18 found that a dominant share of loans restructured after FY12 degraded into non-performing loans (NPLs), according to a Fitch analysis.BLOW HOT, BLOW COLD“You are encouraging bad behaviour by supporting it and demoralising the ones with good behaviour; this is akin to farm loan waiver that leads to bad credit behaviour,” said Kuntal Sur, partner – financial risk & regulation, PwC. “This is nothing but kicking the can down the road, this should not be encouraged.”The concept of regulatory forbearance arose when the RBI allowed project loans to retain their standard asset classification on extension of their repayment schedule in May 1999. This was extended to treatment of restructured accounts in March 2001 under the Corporate Debt Restructuring (CDR) mechanism, for restructuring of debt without the need for an asset quality downgrade if the restructuring plan met certain conditions. For years, asset quality forbearance was used more as a tool for avoiding recognition of defaults and less for their effective resolution.In 2008-09, after the global financial crisis, the RBI agreed to forbear on certain kinds of stressed loan restructuring, hoping that this was a temporary need pending stronger growth. Unfortunately, for a variety of reasons, the stress has not been temporary, and growth in these sectors has proved elusive. This regulatory forbearance was made available to all types of loan restructuring except commercial real estate exposures, capital market exposures and personal and consumer loans.Since 2008, RBI relaxed norms for restructured loans several times and allowed lower provisioning for select categories of loans. Its regulatory relaxations prevented a rise of nearly Rs 90,000 crore in NPAs. These relaxations include allowing unsecured loans to microfinance companies to be restructured in 2011, and allowing second restructuring of loans on a case-to-case basis. State electricity boards and the aviation sector are two notable examples wherein loans were restructured for a second time, but were not classified as non-performing assets. But, in May 2013, the RBI announced the decision to withdraw forbearance on asset classification effective April 1, 2015. Shortly after this, the RBI began its Asset Quality Review (AQR) exercise to determine the “real” stock of the bad loan problem.After the RBI undertook the AQR that led to recognition as NPA of several loans, which banks had then considered to be standard assets, NPAs went up from 4.62% in 2014-15 to 7.79% in 2015-16, and were as high as 10.41% by December 2017.However, in the wake of mounting NPAs, the RBI allowed asset classification benefits for certain types of restructuring schemes. These included Strategic Debt Restructuring (SDR), Flexible Structuring of Project Loans and the Scheme for Sustainable Structuring of Stressed Assets (S4A).74310653 HARD TIMESA revival in GDP growth rate is key to the Indian economy, which has slowed to an 11-year-low of 4.5% in the September quarter. Bank of America’s India Activity Indicator slipped to 3.1% in December from 4.5% in November. The Index of Industrial Production for December shrunk to 0.3% while retail inflation rose to 7.59% in January.“It is not surprising in the current weak operating environment and is in line with a recent trend to weaken asset recognition standards,” said Guha of Fitch. “These extensions are only likely to defer asset-quality pressures unless there is a sustained improvement in macroeconomic conditions. Most of these sectors have had above-average lending growth in the last few years, either directly or indirectly via non-banks, and could be at risk were the economy to slow. Moreover, these measures are unlikely to support sustainable credit growth until capitalisation improves meaningfully across banks, in particular among state-owned banks, which account for nearly twothirds of the sector’s assets.”The MSME sector accounts for over 28% of GDP, more than 40% of exports, while employing approximately 110 million people. The outstanding banking sector credit to MSMEs was Rs 15.11 lakh crore while its gross NPAs were 5.8% of the total credit. Likewise, the real estate sector has been in trouble for quite some time and is the primary reason behind the sustained nonbank lending crisis.“In extreme situations, the economic value of not taking any action is too high,” says Sur. “If you look at the government’s perspective, we are in a slow growth phase; if you allow further defaults, the negative impact could bring down the growth further.”Some believe that difficult times warrant some degree of forbearance, some hand-holding to performing and otherwise viable units in tiding over temporary difficulties. But even RBI data shows that restructuring has been often used by banks for ‘evergreening’ problem accounts, thereby just postponing the recognition of a problem.“Forbearance may be a reasonable but risky regulatory strategy when there is some hope that growth will pick up soon and the system will recover on its own,” Rajan had said in July 2016. “Everyone – banker, promoter, investors, and government officials – often use such a strategy because it kicks the problem down the road, hopefully for someone else to deal with. The downside is that when growth does not pick up, the bad loan problem is bigger, and dealing with it is more difficult.”INSOLVENCY RESOLUTIONCentral bankers on many occasions in the past have said that restructuring schemes were required because India did not have an effective bankruptcy law in place. In 2016, the Insolvency and Bankruptcy Code, 2016 (IBC), which is a comprehensive bankruptcy code, was enacted and notified. The Code envisages timely resolution of borrower defaults through collective decision making by the creditors. But, the success of the law is yet to be proven.“The general approach of bankers to stress in large assets has been one of avoiding the de jure recognition of non-performance of such accounts,” NS Vishwanathan, RBI deputy governor, had said earlier. “This is why we have a history of a large number of cases of failed restructuring as the schemes were used for avoiding a downgrade rather than resolving the asset. Prolonging the true asset quality recognition suited both the bankers and borrowers.”As per the latest data from the Insolvency and Bankruptcy Board of India, 58% of all closed cases under bankruptcy to date were via liquidation while only 14% of cases were resolved with an average haircut of nearly 57% on admitted claims.ENCOURAGE GOOD BEHAVIOUR“Good practices should be encouraged so that there is incentive toward credit discipline. What is the guarantee if the economy goes from bad to worse, these loans will be repaid,” says Sur. “Banks have taken excessive risk in the past which is why we are seeing encouragement of bad behaviour.”While many say that the RBI move is intended to improve monetary transmission, provide credit support to fields that have multiplier effects within the wider economy, the regulator should also bring in rules to reward those with better credit discipline. The regulator is also aware of the risks that the relaxations bring in, but places the onus on banks to ensure that their books don’t have a hole.“Sector-specific pockets of stress need policy attention,” Governor Das said at a conference this week. “At the same time, proper due diligence and risk pricing in lending are of prime importance so that the health of the banking sector is not compromised while ensuring adequate flow of credit to productive sectors of the economy. Timely mitigation measures like faster resolution, better recovery, etc, need to be continued to bring down gross nonperforming assets.’’

Rajasthan plans to set up 30,000 MW solar capacity in 5 years

Jaipur: Rajasthan plans to set up 30,000 MW of solar power plants in next five years and is in talks with leading private and state-run companies to develop energy parks, the state’s energy minister BD Kalla told ET.This will add to an already installed capacity of around 50,000 MW in the state, he said.“We have come up with a new solar policy in which we are giving a host of incentives, including relaxations in stamp duty, electricity duty and transmission and wheeling charges. We are also allowing banking of energy for captive consumption and third-party sale on yearly basis,” Kalla said.Recently, the Centre allocated Rajasthan a 25,000 MW ultra mega renewable energy park. The state government has identified land bank of 125,000 hectares in three districts — Bikaner, Jaisalmer and Jodhpur—for this park.“This park would solely be developed by central public sector units engaged in solar power generation,” said Ajitabh Sharma, principal secretary at Rajasthan’s energy department and chairman of Rajasthan Renewable Energy Corporation, the state’s nodal agency for renewables.“However, we want to promote both private and public sector equally in Rajasthan, which is also one of the objectives of solar policy. Let us first evaluate the proposition of the ultra mega energy park,” Sharma said.He said of the 30,000 MW—the target Rajasthan has set for next five years—the state is looking to install solar plants of 10,000 MW in next three years in the first phase. “We are in talks with many PSUs including NHPC, NTPC, PFC, Tehri Hydro Power and Sutlej Jal Vidyut among few others. While NTPC is looking for 5,000 MW, others are aiming at 1,000 MW each,” he said.

He added that the company has already factored in the possible delay in component supplies in these new launches.“Had there been an impact, we would have delayed launches. Factories have resumed operations in China and things are getting normalised,” he added.

MUMBAI: Great Wall Motors, China's largest SUV maker, is planning to accelerate its way into India’s mass-market sports utility vehicles, priced from Rs 10 lakh to Rs 20 lakh.The automaker plans to roll out its first vehicle by the first quarter of 2021, within a year of acquiring the Talegaon factory from General Motors. This would be followed by an electric vehicle and mid-size SUVs by 2022-2023, said several people in the know.Great Wall will be introducing SUVs under its mass-market Haval brand. First off the block will be a mid-size C segment SUV to rival the MG Hector and Tata Harrier, followed by a premium electric SUV to challenge the MG Motor E-ZS and Hyundai Kona.The core of the offering for Haval in India is the emerging market B SUV platform which has been designed keeping India in mind. The company is likely to have a sub-4-metre version as well as a 4.2-metre version of the platform.As stated before, the company plans to start manufacturing in India in 2021 and plans to have a portfolio of products across all SUV segments, Great Wall Motors India director (marketing & sales) Hardeep Brar told ET.“With an overwhelming response received at the 2020 Auto Expo post showcasing the brand Haval and our product strength, we are excited to lay a solid foundation for India,” said Brar, while refusing to share specifics around timelines and product strategy. To be sure, the aggressive stance of the company can be clearly seen in the fact that post the India entry announcement ahead of the Auto Expo, it acquired GM’s Thailand plant too. These are part of its global expansion plan.This also happens at a time when the Chinese market has started to witness a significant slowdown after years of strong double-digit growth. New Delhi: The government is working on improving the business climate, particularly ease of registering property, in Kolkata and Bengaluru because these two cities will be considered – along with Delhi and Mumbai – when the World Bank prepares its next Ease of Doing Business report.Officials at the departments of promotion of industry and internal trade (DPIIT) and land resources held a meeting with officials of West Bengal, Karnataka, Maharashtra and Delhi last month to discuss various reform measures to improve ease of doing business, a senior government official said.74310310 “A meeting was held to review progress under ease of doing business — registering property in Delhi and Mumbai, and to take up initiatives on various reform measures in Kolkata and Bengaluru on priority,” the official said.The World Bank is due to release the Doing Business 2021 report in October.India’s position in the Ease of Doing Business Rankings for 2020 had improved 14 places to 63 among 190 countries. The country’s ranking on ease of registration of property parameter was a lowly 154, though better than the previous year’s 166.Hence the push to ease property registration.The idea is to digitise and integrate all records relating to titles or encumbrances and make data available on a single portal in Kolkata and Bengaluru, a second official said. “As part of the exercise to reduce number of procedures and time required, we are also working to create digitised land records, cadastral maps, municipal records and utility bills.”There is a plan to register and map all privately held land plots and define timelines for changes in cadastral maps and obtain record of rights under Public Service Delivery Guarantee Act to make it easier to register property in the two cities, the official said.To make it easier to register property, DPIIT and the land resources department are in talks for complete cadastral mapping of all plots, timely disposal of property disputes, and making statistics of land disputes public. An integrated portal for verification of title and encumbrances and a simultaneous action plan to enact Land Titling Bills for all the four cities of Mumbai, Delhi, Kolkata and Bengaluru, are also being considered.This is part of the government’s action plan to make India break into top 50 in the World Bank's annual Ease of Doing Business ranking, which ranks countries on business environment based on ten parameters.

Content, tech companies back separate body, but telcos want regulation

KOLKATA: Telecom carriers and content/ technology companies have sparred over tighter enforcement of net neutrality rules, with the likes of Bharti Airtel calling on the government to reorient its position about the open internet with the advent of 5G, and urged application of net neutrality rules on content providers such as Netflix.In their submissions to the telecom regulator on contours of reasonable internet traffic management practices, content players and technology companies backed an independent and powerful multi-stakeholder body (MSB) that can work closely with the Department of Telecommunications (DoT) and Telecom Regulatory Authority of India (Trai) in monitoring the application of net neutrality regulations.Telcos, by contrast, want light touch regulation, with Reliance Jio Infocomm backing Bharti Airtel in saying there’s no real need to establish an MSB as net neutrality rules are part of licensing conditions enforced by DoT.“A one size fits all approach has become obsolete in the 5G context, and the policy on net neutrality needs to be reconsidered and aligned with the principles and standards of 5G,” Airtel said in its submissions to Trai. 74292752 Investments in 5G, it said, would depend on enabling regulatory provisions, which would help in unlocking the full potential/ benefits of these newer technologies.Airtel also rued that no steps had been taken by the government yet to apply the net neutrality rules on content providers and mobile apps despite the power these entities wield in the internet ecosystem. “Netflix has admitted in the past they were throttling their content on AT&T and Verizon’s networks,” Airtel said.US browser maker Mozilla Corp though called for stringent enforcement of net neutrality rules.“A truly empowered and diverse multistakeholder advisory body would go a long way in cementing India’s position as a leader in net neutrality regulation globally,” the company said.It also called on Trai to emulate the Body of European Regulators for Electronic Communications (BEREC) model to “determine and measure (the extent) of net neutrality violations’’.Software services body Nasscom also wants the proposed MSB to make “non-discrimination of content a top priority,” and boost public awareness levels about the benefits of net neutrality, besides balancing matters such as “accessibility of services, consumer rights and expectations”.Airtel though strongly discouraged the need for an MSB, saying net neutrality principles are already part of a telco’s licensing norms, and DoT is fully empowered to ensure compliance.“If it’s (still) decided to establish an MSB, it should be mandated to advice DoT on enforcing net neutrality principles on entities, other than telecom/internet service providers, such as content providers, device makers, browsers who also have significant impact on internet traffic,” Airtel said in its submissions to Trai.Jio backed Airtel, saying DoT, instead of creating an MSB, should consult an existing industry-led body that can play an active role in assisting it in monitoring and enforcing net neutrality functions, especially since the department intends to retain the monitoring and enforcement functions on this score.Back in August 2017, Trai had recommended a free and open Internet and had even suggested monetary penalties for violation of net neutrality rules, starting at Rs 50,000 per violation per day but capped at Rs 50 lakh. Further, it had mooted an MSB comprising telcos, internet service providers, content providers, civil society organisations and consumer representatives to detect violations.In August 2018, DoT endorsed Trai’s recommendations but said actual monitoring and enforcement of the rules would remain with it, and that the proposed MSB would play only an advisory role.

Gaana tops audio streaming charts with 30% share

MUMBAI: Gaana, the music streaming service owned by Times Internet, has emerged as the leader in the category with a 30% market share in January, according to OTT Audience Measurement Insights, a passive, continuous audience measurement service.Gaana was ahead of competitors including JioSaavn (24%), Wynk and Spotify (15% each), and Google Play Music (10%), in the music streaming space last month, according to the first OTT Audience Measurement Insights report. All other music services, including Amazon Prime Music and YouTube Music, put together had a 7% market share."Happy to note that the Kantar report reinforces the fact that Gaana is the clear market leader in audio OTT,” said Prashant Agarwal, CEO - Gaana.“As the industry leader, we have constantly innovated on the user experience to appeal to the first-generation mobile internet user and gained a deep understanding of the Indian music lover’s preferences that will now help us onboard the next quarter-billion Indians from tier II and tier III cities onto the music streaming bandwagon.”The OTT audience measurement service has been launched by WPP-owned media measurement platform Kantar and audience measurement technology company VTION. The report is based on data collected from more than 9,000 mobile users in the country’s top nine cities (Delhi, Mumbai, Kolkata, Chennai, Bengaluru, Hyderabad, Pune, Ahmedabad and Lucknow/Kanpur). Bidders get till March 6 to pose queries on Air India stake sale

NEW DELHI: The government has extended the time till March 6 for bidders to pose additional queries regarding sale of its 100% stake in Air India. The government has issued the first set of clarification on Air India disinvestment answering queries of interested bidders on the 'confidentiality undertaking' listed out in the Preliminary Information Memorandum (PIM) issued on January 27.The last date for submission of written queries on PIM and Share Purchase Agreement (SPA) was originally set at February 11, following which the Department of Investment and Public Asset Management (DIPAM) on February 21 issued a set of 20 clarifications on the queries raised. The additional time period for submission of written queries on PIM and SPA is till March 6, 2020, the DIPAM said.The government in January restarted the divestment process of Air India and invited bids for selling 100 per cent of its equity in the state-owned airline, including Air India's 100 per cent shareholding in AI Express Limited and 50 per cent in Air India SATS Airport Services Private Ltd.The last date for putting bids is March 17 and interested bidders for Air India should have a net worth of Rs 3,500 crore.After its unsuccessful bid to sell Air India in 2018, the government this time has decided to offload its entire stake. In 2018, the government had offered to sell its 76% stake in the airline.Of the total debt of Rs 60,074 crore as of March 31, 2019, the buyer would be required to absorb Rs 23,286.5 crore, while the rest would be transferred to Air India Assets Holding Ltd (AIAHL), the special purpose vehicle. As a precursor to Air India sale, the Cabinet in February 2019 approved setting up AIAHL to transfer Rs 29,464 crore worth loans of the national carrier and its four subsidiaries — Air India Air Transport Services (AIATSL), Airline Allied Services (AASL), Air India Engineering Services Ltd (AIESL) and Hotel Corporation of India (HCI).

Top government officials urge Trai to fix floor tariffs soon

NEW DELHI: Officials at the highest levels of the government have nudged the Telecom Regulatory Authority of India (Trai) to expedite fixing of a floor for tariffs, a move considered crucial by all operators for restoring the long-term viability of the telecom sector.“The regulator is being pushed to soon come out with a floor price, once the consultation completes this month,” a senior government official told ET.Prodded by the sector and the government to come up with a floor price, a reluctant Trai in December floated a consultation paper to fix a floor price for voice and data services on telecom networks. It, however, warned that such an exercise has historically been termed ‘market distorting’ by economists. It also called the move “anti-consumer”. The deadline for filing comments and counter comments has been extended till February 28 and March 13, respectively.Telcos like Bharti Airtel have said that average revenue per user (ARPU) needs to go up initially to Rs 200, and eventually to Rs 300, for which a floor price was needed. Telcos and experts say setting a floor price is expected to hasten revenue recovery at the sector, thus giving confidence to lenders and investors about the sector’s viability, say experts.The push for floor pricing comes with Vodafone Idea struggling to generate funds to pay its adjusted gross revenue (AGR) dues by the March 17 deadline set by the Supreme Court. The government is considering offering soft loans to stressed telcos, besides other steps, but there is a debate on who will fund this loan.At an inter-departmental meeting on Sunday, finance ministry officials suggested that banks should offer loans on easy terms to Vodafone Idea to help meet the AGR dues, officials involved in the discussions said.The finance ministry was against using the Rs 51,000-crore lying in the Universal Services Obligation Funds (USOF) kitty, or using the consolidated fund of India — as proposed by telcos — that would drain the government of any finances. Telcos contribute 5% of their AGR — which is part of the 8% licence fee — towards USOF.74292738 “But banks would obviously be jittery, given Vodafone Idea’s market cap is far lower (Rs 11,149.33 crore at Monday’s close of trading) than its dues worth Rs 57,000 crore (as per the government’s estimates),” a senior government official told ET.Vodafone Idea’s own estimates have pegged its AGR dues at around Rs 23,000 crore, of which Rs 7,000 is the principle. It has paid only Rs 3,500 crore so far.

NPPA tells chief secys to keep tabs on API availability

New Delhi: India’s drug pricing regulator has asked state governments to closely monitor availability of active pharmaceutical ingredients (APIs) and formulations as part of efforts to ensure that there is no shortage of bulk drugs in the backdrop of the coronavirus outbreak.In a letter to the chief secretaries, the National Pharmaceutical Pricing Authority (NPPA) has asked them to ensure that there is no violation to the provisions of the Drug Pricing Control Order (DPCO) with regard to compliance of selling price. 74292740 “In that case, necessary action will be taken,” the letter dated February 20 said, reflecting the government’s determination to curb possible black marketing and hoarding. ET has reviewed the letter.The regulator has also asked chief secretaries to closely monitor availability of APIs as a measure of public health preparedness in respect of APIs, intermediates and key starting materials which are imported from China. APIs are the key raw materials used for making pharmaceutical formulations like tablets, capsules and syrups.“Chief secretaries have been asked to monitor companies are complying with the selling price too,” a senior official told ET.On February 19, government think tank Niti Aayog had held a meeting with top drug makers and policy makers to discuss options for domestic manufacturers of critical APIs in which India is dependent on imports. To attain self-sufficiency in bulk drugs and reduce dependence on China, it was suggested that production capacity should be built for 58 APIs on which India is significantly dependent on China.According to data available with the Pharmaceutical Export Promotion Council (Pharmexcil), the cost of paracetamol has gone up from Rs 250-300 a kg to Rs 400-450. Similarly, “montelukast sodium (anti-asthmatic drug) is trading at Rs 52,000-58,000 per kg, compared with Rs 33,000-38,000 a few months ago,” said Dinesh Dua, chairman, Pharmexcil, which functions under the commerce ministry. Similarly, prices of vitamins and penicillin have also shot up by 40-50%.

American and Indian negotiators have blamed the other side for a lackadaisical response and for shifting the goalposts respectively.High tariffs and trade deficit with India are a constant refrain of Trump’s bashing of India as ‘tariffs king’. He has accused the country of denying American products an ‘equitable and reasonable access’ to its markets. The visiting president has assured his voters that he will ‘talk business’ with Prime Minister Narendra Modi.PM Narendra Modi should use the occasion to talk business with his guest by conveying some relevant facts. India does not figure even among the top 10 countries, which includes Ireland and Malaysia, with which the US runs trade deficits. For 2019, the US trade deficit with India at $23.3 billion dwarfs the corresponding figure for China -- $346 billion.The Trump government’s aggressive stance seems to be guided by a belief that trade is more consequential for India than the US. The latter is the second largest trading partner of the former, but India comes a distant eighth among the US’s largest trading partners. This is a rather short-sighted view. India is already the third largest market and its economic heft is, despite a slowdown, growing by the year.India is generating Big Data – the proverbial ‘new oil’ -- in super abundance. The country is witnessing unparalleled growth in mobile data fueled by low-cost connectivity enjoyed by 800 million users. Several US tech giants, like Facebook and Google, are already earning substantial profits using Indian data. In the coming years, a much larger number of US firms will need access to Indian data to create jobs and wealth in their country in activities such as artificial intelligence (AI), robotics, Internet of Things (IoT), cloud computing, data analytics, and nanotechnology. Potential gains from cooperation are many.But there are serious differences. The Trump government demands easy access for its dairy and agriculture products to 1.3 billion Indian consumers. It is opposed to the Indian measures to make healthcare affordable -- price caps on drugs and medical devices like cardiac stents and knee implants. Differences also abound over rules for data localisation and e-commerce.These issues have resulted in trade skirmishes. It started with the US raising the import duty on Indian steel and aluminium products -- as ‘national security measures’ against a country that’s supposed to be its ‘strategic partner’! India retaliated by dragging the US to the dispute settlement mechanism of the World Trade Organisation (WTO) and increased duties on import of 29 products from the US, including almonds, walnuts, and pulses.To ratchet up the pressure, from June 2019, the US suspended India's special status under the Generalised System of Preferences (GSP) that provided duty-free access to $5.6 billion worth of Indian exports. Admittedly, the concession was revoked in response to the ‘failure of the Indian government to provide equitable and reasonable access to its markets in numerous sectors’. In keeping with his reputation as transactional leader, just before embarking on his India sojourn, Trump has classified India as a ‘developed nation’ to eliminate the concessional treatment to India in countervailing duty investigations against its exports.Trump and Modi should use the visit to work out a framework for addressing the differences in the spirit of give and take. Their decisions will have real impact on people’s lives and long-term economic consequences in areas ranging from agriculture to health to manufacturing, digital trade, ecommerce and big data.For a start, the two countries should restore the status quo ante by reversing increases in duties imposed on each other, and withdrawing complaints at WTO. The US should restore GSP status for India. The gains from it can be used by India to buy US goods, including oil and gas.The Indian side should also realise that a flexible policy can work better for the country. For instance, not all drugs and medical devices like stents and implants are the same. It is not necessary to have price cap on all. There are standard-use products and devices, and their more advanced versions, which must be differentiated by price to incentivise drug and device companies to bring their latest products to the Indian market. Otherwise, India will lose out on the latest drugs and techniques in healthcare.One possibility is to go for an across-the-board trade margin rationalisation in view of the costs and expenses incurred by producers. The import duties on high-end Harley-Davidson motorcycles can also be slashed without adversely affecting the domestic motorbike industry.The agriculture and dairy sectors are complex. India needs to protect the livelihoods of some 500 million dependent on these sectors who are no match for their US counterparts. Besides, there are cultural sensitivities. India demands certification that dairy imports are not sourced from the milk of animals raised on bovine extracts-based feed. This is unacceptable to the US. One possibility is quota-restricted imports with clear package labelling regarding cattle feed. India should be open to import of more fruits such as blueberries and cherries.Finally, in its own interest, India should further liberalise foreign direct investment (FDI) norms and facilitate investment by US companies in infrastructure, storage capacity, manufacturing plants and insurance sectors. Addressing these and other issues such as intellectual property rights (IPR) will require the two sides to work in the spirit of cooperation befitting the world's two largest democracies.The writer is professor, Delhi School of Economics

Daiichi-Ranbaxy arbitration case: Singh brothers hearing in Singapore Supreme Court starts today

NEW DELHI: The Supreme Court of Singapore will, from Monday, hear a plea by former Ranbaxy promoters Malvinder and Shivinder Singh that challenges Japanese drug maker Daiichi Sankyo’s arbitration award.A Singapore tribunal in 2016 awarded Daiichi Rs 3,500 crore in damages. In May that year, the company moved Delhi High Court to enforce the award. The Singhs appealed against it in Singapore as well as India.“The final hearing will begin tomorrow in the Supreme Court of Singapore. Senior counsels of Malvinder and Shivinder Singh in Singapore will appear,” a person in the know told ET.Senior advocate Harish Salve in 2017 filed an application to represent the Singh brothers. He sought an exemption from a Singapore law that generally bars foreign lawyers from appearing in local courts.However, he was denied by the Singapore court.Among other things, the court said no questions of Indian law were involved at that stage. Even at an earlier stage, when issues related to Indian law had arisen, the sellers had employed senior counsel from Singapore, the court noted, and only filed evidence from Indian law experts to defend their cases.Delhi High Court in January 2018 ruled in favour of Daiichi.

Covid-19 outbreak: Non-ferrous metals slip on slow China demand

MUMBAI: The outbreak of Covid-19, or novel Coronavirus, has put pressure on non-ferrous metals aluminium and copper, with analysts forecasting a weak last quarter for Indian producers.Aluminium and copper prices have dropped nearly 5% since the outbreak on January 21, to trade at Rs 138.10 per kg and Rs 430.30, respectively, on the MCX as of Friday. Similarly, LME prices of aluminium fell to $1,676 per tonne on Friday from $1,810 on January 21, while copper slipped to $5,701 from $6,158 a tonne in the same period.“China being the major consumer of metals, the outbreak has put a stop to major manufacturing and import, which is likely to have a major effect on the entire supply chain, reducing demand from January to March,” said Akshay Agarwal, managing director, Acumen Capital, adding that the brokerage maintains a bearish outlook on the metals market overall.Companies are likely to take a hit on exports and see profit margins shrink due to falling prices, analysts said. The impact is, however, largely expected to be confined to the current quarter, as prices recover in medium term, they said.“Non-ferrous companies will continue to slide in Q4, with China battling Covid-19. Average aluminum price is down by $10, alumina by $7 and zinc by $101 on a quarterly basis, reflecting the continued weakness in the sector,” said senior research analyst Vishal Chandak of Emkay Global in a recent report.Hindalco Industries, the largest producer of aluminium and copper, said the outbreak has not hit numbers but may get affected by its purchase of US-based aluminium rolled products maker Aleris. “We have downgraded Hindalco from ‘buy’ to ‘hold,’ reflecting muted to lower aluminium prices and increasing likelihood of Aleris acquisition without automotive body sheet plants, which will make the acquisition value-expensive in the short run,” said the report. A lower premium on physical aluminium may impact Novelis’ profitability.

Altico's 3 bidders revise their offers yet again

MUMBAI: All three suitors for Altico Capital — SSG Capital, Cerberus Capital Management and the incumbent management team — have revised their offers further, as lenders to the cash-strapped home financier drive a hard bargain that may see them recover at least 67% of the total dues upfront, said people in the know.The three submitted their latest offers on Friday after lenders had met last Monday to consider the earlier proposals. A key issue is whether to wind down Altico or keep it as a ‘going concern’. Creditors and bidders are slated to meet Monday.The revised proposal by Hong Kong-based SSG offers two options. The first includes a complete cash and equity offer similar to that of Cerberus. The second is comparable to the previous offer by SSG that included Rs 2,150 crore of upfront payment plus Rs 1,500-1,750 crore of security receipts. SSG has also suggested that the bad loans of Altico be moved to an asset reconstruction company chosen by the lenders.All Eyes on ResolutionAltico, then, will continue as a much smaller organisation with a shrunken book. The employees are likely to be absorbed as the company will be repositioned as a lendercum-advisory firm.74275422 Cerberus has raised its offer a third time, keeping the broad structure intact — the new offer includes around Rs 2,600 crore cash and Rs 450 crore of security receipts payable when possible, along with an equity infusion of Rs 1,000 crore to complete projects. The shareholder resolution offer is similar to the last one but some equity commitment has been added as a sweetener.The Clearwater-backed Altico management had suggested 100% repayment of the principal amount with outstanding interest being paid back at 10% over 5.75 years. But this hinged on Clearwater taking control of Altico as part of the resolution process. In this formula, the existing shareholders will agree to pay Rs 630 crore by March 2021, which will be counted as year one. In years two and five, the management will make fresh equity infusions to keep the business viable, said people briefed on the matter. Alternatively, the shareholders have suggested that some lenders could get repaid before 5.75 years but only if they agree to a 30% haircut. They will get 70 cents to the dollar at the same coupon.“The credit committee is meeting on Monday along with the bidders, who will again present a detailed resolution plan,” said an executive. “An informal show of hands is also expected after the meeting. By March 20, a final resolution is expected after a final vote.” That vote is expected to be held on March 12. SBI Capital and EY, advisers to the lenders, will analyse the bids.SSG, Cerberus and Altico declined to comment. SBI Caps didn’t respond to queries.Crisis & OpportunityThe creditor-run recast is being keenly tracked for an indication on how the country’s shadow banking crisis will be resolved and the opportunity this presents for hedge funds, structured debt and distressed asset investors. The real estate lender faced a liquidity crunch in September and defaulted on Rs 138 crore of debt repayments.Lenders are struggling to realise a higher value in other big cases, including Dewan Housing Finance Corporation Ltd and Infrastructure Leasing & Financial Services, as they have stopped their core business activities.“It is important to keep any entity as a ‘going concern’, which is why lenders are insisting on it for Altico,” said an executive involved in the process.
