Police start removing barricades at Tikri border
The Delhi Police on Thursday night started removing roadblocks placed at the Tikri border point where farmers have been protesting against the Centre's three farm laws, with sources indicating that one carriageway of the road will open in the coming days.The move comes days after a Supreme Court hearing that saw farmer unions arguing that the police were responsible for the blockade at the Delhi borders.The police had put multiple layers of barricades on the roads, complete with giant nails and huge concrete blocks as thousands of farmers had tried to cross Delhi borders in November last year.Four out of the eight layers of barricades at the Tikri border have been removed. However, the cement barricades are still there and the road remains closed for commuters, an officer said.In videos doing the rounds on social media, JCB machines were seen removing blockades at the Tikri border.Sources in the Delhi Police said that such exercise is likely to be launched at Singhu and Ghazipur border points in the coming days.Thousands of farmers have been camping at the three borders points --- Tikri, Singhu and Ghazipur --- protesting the Centre's three farm laws since November 26, 2020.About the removal of blockades at the Tikri Border on Thursday night, a senior police officer said some layers of barricades that were placed by the police have been removed."The arrangement at the Tikri border in terms of infrastructure has been reduced. Seven to eight layers of different types of barricades were placed earlier and we have removed some of them," the officer said.This is done as a move to open the road for traffic soon, he said."At present, there is no traffic flow as the roads are closed. Barricades will be completely removed soon to slowly ease the flow of traffic," the officer added.The Supreme Court on October 21 had said farmers protesting at Delhi borders against the three farms laws have the right to agitate but they cannot block roads indefinitely even as the farmer unions and the government got embroiled in a blame game.While the farmers' unions alleged that the police were responsible for the blockade as it suits them to allow a feeling among citizens that farmers are blocking the road, the Centre said there was an oblique purpose behind the protests.After the court hearing, the Bhartiya Kisan Union (BKU), whose supporters and office-bearers led by Rakesh Tikait are camping at Ghazipur on the Delhi-Uttar Pradesh border since November 2020, had said the barriers at the protest site have been put by the Delhi police and not farmers.Tikait, the national spokesperson of the BKU, said protesters at Ghazipur have cleared the path on a service lane leading to the national capital but Delhi Police's barricades were still present there.

Travel service providers expect more countries to ease travel requirements for Indians vaccinated with Covaxin even as the World Health Organization (WHO) this week sought additional clarifications from Bharat Biotech before granting emergency use licence (EUL) for its Covid vaccine.Oman added Covaxin to the approved list of Covid-19 vaccines for travel on Wednesday, lifting quarantine requirement for passengers from India who have received two doses of the vaccine at least 14 days before the estimated arrival date. Travel platforms said they are seeing an uptick in bookings for destinations that are accepting Covaxin such as Greece, Sri Lanka and Mauritius. "While WHO acceptance opens the doors to multiple global destinations and is certainly of value, individual governments can take an independent call," said Romil Pant, senior vice-president, leisure travel at Thomas Cook (India). "And, of course, what is a clear positive is that several destinations such as Dubai, Maldives, and Russia offer entry irrespective of vaccine status with checks and balances like RT-PCR being in place," he said. "With the WHO expecting to reconvene for the final risk-benefit assessment for Covaxin on November 3, we are hopeful of an approval this time round," Pant said. Nishant Pitti, CEO of EaseMyTrip, said that while countries are not bound by WHO suggestion and can decide on their own to recognise Covaxin, approval by WHO will work as a shot in the arm. "A significant part of our population is vaccinated with Covaxin. The approval will further enable more travellers to visit their favourite international destinations," he said. Ixigo said countries such as Serbia have recognised Covaxin based on a 'mutual acceptance' of vaccines, while Oman has possibly approved it for ease of travel of Indian nationals. "Similarly, for ease of travel and to attract tourists, Mauritius is also accepting Covaxin," the company said. "Global acceptance of Covaxin will definitely ease international travel plans for Indian travellers who are currently vaccinated with Covaxin but cannot travel or have to face mandatory quarantine due to current restrictions." Subhash Goyal, chairman of STIC Travel and Air Charter Group, pointed out that Prime Minister Narendra Modi and some cabinet ministers have taken Covaxin and it has been cited as being effective against the Delta variant. "Some people have preferred Covaxin over Covishield seeing encouraging findings. Some countries are recognising Covaxin bilaterally," he said. "So, the sooner WHO recognises it the better. There should not be unnecessary delays just because it is from a developing country." Daniel D'Souza, president and country head at SOTC, said he is hoping for positive news for travellers doubly jabbed with Covaxin. "As per a recent report, the United States Centres for Disease Control and Prevention (CDC) has given clearance to Covaxin with certain riders. If more countries approve of Covaxin it will enable Indians to pursue their long-pending travel plans," he said.

Bengaluru | Mumbai: Paytm founder Vijay Shekhar Sharma is increasing his shareholding in his company’s insurance venture, where Zurich-based Swiss Re is picking up a 23% stake.Sharma and two of his holding companies — VSS Holdco and VSS Networks — together will own close to 66% in Paytm Insuretech, according to Paytm’s red herring prospectus and people briefed on the matter. Paytm parent One97 Communications’ shareholding in the insurance arm will come down to a little over 11%. Sources aware of the matter said One97 Communications has also cancelled an approved resolution of lending around $100 million to Sharma for the insurance deal. He will finance the deal on his own, they said.Sharma is expected to finance his stake purchase in the insurance unit by selling some of his shares in the Paytm IPO (as part of the offer for sale component). He is also taking a loan from banks to close the deal, which is subject to regulatory approval. The 43-year-old, who is also managing director and chief executive of Paytm, owns close to 15% in the company. He will sell shares worth over Rs 402 crore in the IPO, according to the RHP. With this, Sharma will have majority control in the insurance unit, which is valued at around $500-$550 million based on Swiss Re's investment for a 23% stake.Last year, when it announced the deal to acquire Raheja QBE, the acquiring entity was QorQl (now renamed Paytm Insuretech) and Sharma owned 51%, with the rest by One97 Communications.“The loan was approved by One97 Communications before Paytm filed the draft red herring prospectus (DRHP) but it has been cancelled now as Sharma is arranging it on its own. It will be available once the regulatory approval is in place,” a person briefed on the matter said.Paytm has a call option on Sharma’s stake in the insurance business, which is being seen as a key part of the company’s efforts to establish itself as a financial services group. “There is a thinking that Paytm Insuretech would be a unicorn (firms valued at $1 billion or more) in the near future as it scales the insurance business. It is already at over $500 million,” another person added.A spokesperson for Paytm declined to comment on the matter.Once the capital infusion happens, VSS Holdco and VSS Networks will together have 54.48% in Paytm Insuretech, while Sharma will have 11.49% and Paytm 11.03%. According to the announcement made by Paytm on Wednesday, Swiss Re is making an upfront investment of Rs 397 crore. The rest of the money will come in tranches depending on certain business milestones.On July 29, ET reported that Sharma was looking at a joint venture for the general insurance business and that the insurance regulator was in favour of a more diversified ownership structure for a general insurance entity.Even though Paytm’s parent firm is incorporated in India, it is treated as a foreign company by financial regulators, since a majority of its investors are foreign entities. This will remain the same even after its listing.Paytm has an insurance broking licence through a wholly owned subsidiary, Paytm Insurance Broking. Foreign direct investment (FDI) in insurance is limited at 74%, but overseas investors can own 100% of broking businesses.

India rejects net zero carbon emissions target
India on Wednesday rejected calls to announce a net zero carbon emissions target and said it was more important for the world to lay out a pathway to reduce such emissions and avert a dangerous rise in global temperatures. India is under pressure to announce plans to become carbon neutral by mid-century or thereabouts at next week's climate conference in Glasgow. But environment secretary R.P.Gupta told reporters that announcing net zero was not the solution to the climate crisis. "It is how much carbon you are going to put in the atmosphere before reaching net zero that is more important." The United States, Britain and the European Union have set a target date of 2050 to reach net zero, by which point they will only emit an amount of greenhouse gases that can be absorbed by forests, crops, soils and still-embryonic "carbon capture technology. China and Saudi Arabia have both set targets of 2060, but these are largely meaningless without tangible action now, critics say. Between now and the middle of the century the United States will release 92 gigatons of carbon into the atmosphere and the EU 62 gigatons, Gupta said, citing Indian government calculations. China would have added a staggering 450 gigatons by its net zero target date, he added. Representatives of nearly 200 countries will meet in Glasgow, Scotland, from Oct. 31-Nov. 12 for climate talks to strengthen action to tackle global warming under the 2015 Paris Agreement. Indian Prime Minister Narendra Modi will attend the conference in a sign of how the country is taking climate change seriously, officials say. Chinese President Xi Jinping is not expected. While working towards net zero, countries are expected to announce new and strengthened intermediate targets for cutting emissions. Environment Minister Bhupendra Yadav said India was on track to achieve targets set at the 2015 Paris conference and left the door open to revising them. "All options are on the table," he said. India has committed to cutting the emissions intensity of its GDP by 33%-35% by 2030 from 2005 levels, achieving a 24% reduction by 2016. Some environment experts say India could consider lowering its emissions intensity by as much as 40 percent dependent on finance and whether it has access to newer technologies. Yadav said he would measure the success of the Glasgow conference by how much it delivered on climate finance to help the developing world cut their emissions while ensuring economic growth.

One of the world's most overly punitive, confusing and ineffective drug laws seems to be readying for change. In a paradigm-shifting move, India's ministry of social justice and empowerment recently sent a proposal to the department of revenue to decriminalise possession of small quantities of all 'hard drugs' as defined in the Narcotic Drugs and Psychotropic Substances (NDPS) Act. The suggestions purportedly step away from subjecting drug users to irrational aspects of the criminal justice system, and puts science and public health before punishment and incarceration.Possession of drugs is as much an offence under the NDPS Act as their sale, purchase and production. The punishment does not depend on whether the possession or purchase is for personal use or for resale, but depends on the quantity of the drug. While 'decriminalisation' sounds like music to the ears, court-mandated substance abuse treatment actually maintains status quo.In the existing NDPS Act, Section 64A, which was added in 1989, already provides full immunity from prosecution to addicts volunteering for treatment. It provides immunity to the addict not only for consumption (Section 27) but also for offences involving small quantities of drugs. So, it's unclear what is new in this latest proposal. One hopes this doesn't amount to addicts getting immunity only for consumption while revoking it quietly for all 'offences' involving small quantity of drugs. This would make our drug laws even more regressive than they already are.In 2017, the Sikkim Anti-Drugs Act (SADA) was amended to recognise the difference between 'peddlers' and 'users'. This enabled Sikkim to channelise its healthcare services to the most vulnerable of drug users. However, anybody caught with small quantities of drugs were now categorised as a consumer, while those caught with larger quantities were categorised as peddlers. But differentiating between consumers and peddlers merely on the basis of the quantity of substance often led to users being arrested as peddlers.Such a quantity-based distinction fails to recognise that a large group of people turn to peddling to support their addiction, and harsher punishment becomes a big hindrance in their chances of recovery.Then there is the matter of court-mandated substance abuse treatment in the proposal. In the 2012 'Gurjit Singh vs State of Punjab' judgment, the Punjab-Haryana High Court encouraged that the petitioner be sent to a state-run rehabilitation centre for treatment on an 'experimental basis'. The court further directed the Punjab government to identify addicts involved in NDPS cases and make arrangements for their treatment and consequential rehabilitation. Referring to the rise of a therapeutic culture in the US where drug offenders are treated as victims of a biopsychosocial disease, the court suggested that state(s) be directed to provide treatment as alternative to prisons, separate youth detention facilities in jails and probation homes.This is all very well. But where is the infrastructure today to support such a rehabilitative approach? Also, addiction treatment in India remains overwhelmingly medieval, to put it lightly. There is a huge difference between a recreational user and an addict, the same way a social drinker is not an alcoholic. The new laws will give immunity to an addict, but will it provide immunity to a user? In a court, will a recreational user who is not an addict then claim to be one to avoid incarceration?The Indian State and society are still unsure whether a drug addict is a criminal or a diseased person. The NDPS Act throws a drug user behind bars, while the social justice ministry on its website says it 'recognises' drug abuse as a 'psycho-socio-medical problem', 'use' and 'abuse' being interchanged freely.We need to define addiction as an illness in the Indian legislature. The government, on its part, should launch an insurance scheme to cover the cost of treatment, de-addiction and rehabilitation for drug addicts. This will also encourage private insurance companies to include it in their health insurance policies. After decriminalising all drug use, defining addiction as an illness, and including it in the NDPS Act and the Mental Healthcare Act, GoI must ensure that all drug addicts are treated equally before the law as any other physically or mentally ill patient.India's drug policy was copy-pasted from the US via Richard Nixon's declaration of 'war on drugs' in 1971. Let's not repeat the same mistakes again of blindly copying the west if we don't make policies that are truly based on science, compassion, health and human rights. Adani Enterprises in talks for $2bn mega fundraise

Wankhede to remain in charge of probe: NCB
Narcotic Control Bureau zonal director Sameer Wankhede will remain the investigating officer in the drugs-on-ship case until 'substantial information' is found against him, NCB deputy director general (northern region) Gyaneshwar Singh has said.A five-member team led by Singh had earlier in the day recorded Wankhede's statement for four hours during its probe against him following allegations made by a witness in the ship case, Prabhakar Sail, that there was an 'extortion bid of ₹25 crore' for the release of actor Shah Rukh Khan's son Aryan Khan, who has been in jail for more than three weeks now."He has put forward many facts before the team. If necessary, more evidence and documents will be sought from him," Singh said. The team will also record statements of others linked to the probe.The Bombay High court, meanwhile, continued to hear arguments in the bail plea filed by Khan and the other two accused, his friend Arbaaz Merchant and a model Munmun Dhamecha. Reading from the arrest memo, senior counsel Amit Desai who appeared for Khan said that on October 3 the accused were arrested only under Sections 20(b) and 27, indicating that the allegations were only for consumption of drugs and not conspiracy. The officer who conducted the arrest treated them as 'unconnected'. The remand application also did not have any evidence of conspiracy, Desai said and contended, hence, there was no conspiracy in the instant case. It was, at best, a case of consumption with unconnected persons, and not a conspiracy. He also stressed the fact that no medical test was done on the accused.Desai said the WhatsApp chats did not support any conspiracy theory. "They are from over three months old and inadmissible as evidence for purposes of an NDPS case," he said. There was no seizure memo on the mobile phones either. A memo was required to ensure veracity of the seizure, so that there was no scope of phone tampering, he said. Senior Advocate Mukul Rohatgi said that there was no reason for arrest given in the arrest memo in the instant case either.NCB contended that Khan was an 'influential person' and was 'likely to tamper with evidence' or 'flee justice' if granted bail. It said evidence showed Khan was in "touch with persons abroad who were a part of an international drug network". The NCB also said Khan was not just a consumer of drugs, but also involved in 'illicit drug trafficking'. NCB alleged that Khan and Shah Rukh Khan's manager Pooja Dadlani were 'tampering with the evidence and witnesses' in the case to derail the investigation.

"Prime Minister Modi has prioritised solar in particular very heavily and you see both big solar farms and small small scale, village scale solar. In green hydrogen India will soon be very successful."However, he said that the country has an important and critical task ahead in terms of cleaning up the rivers like the Ganga and other large rivers that are extremely polluted.Further, he spoke of the need for the government to provide an initial impetus in terms of promoting electric vehicles (EVs), which he believed is the future of sustainable transportation. In this regard, he said India could take a leaf out of the way Norway has dealt with promoting EVs."When we decided, from the government side, that we really wanted to promote electric vehicles, we first changed the tax structure, so they become cheaper relative to the combustion engine cars," Solheim said. "And then city governments made charging stations in the streets and many employers installed charging stations in their parking lots. But that was the beginning, after some time the market took over."He said that gasoline stations in Norway were then reduced to places where people went to buy things like sausages, newspapers, chocolate, tobacco and the like. And in a bid to lure customers back to their stations, they didn't have much of a choice but to set up charging stations."In a place like India, you need an introductory offer to get people hooked on electric vehicles," Solheim said. "And in the early days in a city like Chennai it will do well to provide some charging stations. But when it starts rolling, the market will take over, because lots of people can make money selling electricity. So then the role of the government is much less and after some time may not be needed at all."Solheim said that we're in the midst of the fourth Industrial revolution and the few sectors that will witness tremendous growth and will become crucial include biotech and medicine, digital transformation and green and sustainable businesses.Norwegian companies are also looking to expand their footprint in the Indian market and are keen to tap the potential that the country offers, Ambassador of Norway to India, Hans Jacob Frydenlund told ET. He said that in the past, these companies have preferred China to India owing to the predictability that the country offered. "India, for a Norwegian company, is not an easy market to come into," Frydenlund said. "The political system is different. The market is big, and for an outsider it is difficult to get in and get a clear impression. The competition is also fierce. So very often, you need to have made a very deliberate strategic decision to go into the market."He added that the ease of doing business has certainly gotten better and that the proof of this lies in the number of big companies that are thriving in the country, particularly in places of substantial economic activity like Mumbai. He said the main areas of focus that Norway will look at in India concern integrated ocean management, hydrogen, and renewable energy in addition to broad heads of climate and environment.

Home Ministry wants 3,000 extra posts at NCB
Citing drug menace as an internal security threat, the Ministry of Home Affairs (MHA) has pitched for creation of additional 3,000 posts at the Narcotics Control Bureau (NCB) to expand its nationwide footprint. The MHA has taken up the proposal with the finance ministry to provide logistical and manpower support in setting up and strengthening bureaus in Andhra, Telangana, Chhattisgarh and Odisha, among other states, said people aware of the matter.The MHA is responsible for administrative control of the NCB and for coordination among various central and state agencies. In 2016, it set up a Narco Coordination Centre (NCORD). This system was restructured in 2019 into four tiers up to the district level for further coordination and cooperation among various stakeholders. Officials familiar with the proposal to expand the NCB's footprint said that at present the agency functions with a strength of 1,100 personnel across India. When contacted, the home ministry spokesperson did not comment on the developments. "Due to paucity of workforce, we have to rely on other agencies and state police, due to which quality of investigations suffers at times, as not all forces are trained to handle drugs investigations," said a senior official.The NCB is presently in the eye of the storm over the arrest of Bollywood superstar Shah Rukh Khan's son, Aryan Khan, under the Narcotic Drugs and Psychotropic Substances Act (NDPS) Act. As first reported by ET on October 20, the MHA along with other central ministries has mooted a proposal on strengthening the NDPS Act and empowering law enforcement agencies under the Act.Besides the NCB, the Directorate of Revenue Intelligence, customs and excise, BSF, Sashastra Seema Bal and Indian Coast Guard have been granted powers for making interdiction of narcotic drugs in remotest and far-flung areas of the country and along the border. Further, the MHA wants to wrest the control over the NDPS Act from the Department of Revenue on the grounds that it is responsible for coordination and liaison against illicit traffic under the various international conventions and protocols, state governments and other authorities under the Act.

US urged not to impose CAATSA sanctions on India
Two powerful US Senators on Tuesday urged President Joe Biden not to impose provisions of the punitive Countering America's Adversaries Through Sanctions Act (CAATSA) against India for buying the S-400 surface-to-air missile system from Russia. In a letter to Biden, Senators Mark Warner of the Democratic Party and John Cornyn of the Republican Party urged the president to grant a national interest waiver to India as provided under CAATSA as this is in America's national security interest. "We strongly encourage you to grant a CAATSA waiver to India for its planned purchase of the S-400 Triumf surface-to-air missile system. In cases where granting a waiver would advance the national security interests of the U.S., this waiver authority, as written into the law by Congress, allows the President additional discretion in applying sanctions," the two Senators wrote. Warner is Chairman of the Senate Permanent Select Committee on Intelligence, and Cornyn Senate Minority Whip for the GOP. Both are co-chairs of the Senate India caucus, the only country specific caucus in the US Senate. "We share your concerns regarding the purchase and the continued Indian integration of Russian equipment, even with these declining sales. We would encourage your administration to continue reinforcing this concern to Indian officials, and engaging with them constructively to continue supporting alternatives to their purchasing Russian equipment," they wrote. In October 2018, India signed a USD 5 billion deal with Russia to buy five units of the S-400 air defence missile systems, notwithstanding warning from the then Trump administration that going ahead with the contract may trigger US sanctions under CAATSA. The S-400 is known as Russia's most advanced long-range surface-to-air missile defence system. CAATSA is a tough US law which authorises the administration to impose sanctions on countries that purchase major defence hardware from Russia in response to Russia's annexation of Crimea in 2014 and its alleged meddling in the 2016 US presidential elections. In their letter, the two senators wrote that while India has taken significant steps to reduce its purchases of Russian military equipment, it has a long history of purchasing arms from the Soviet Union, and later Russia. "In 2018, India formally agreed to purchase Russian S-400 Triumf air-defense systems after having signed an initial agreement with Russia two years prior. We are concerned that the upcoming transfer of these systems will trigger sanctions under the Countering America's Adversaries Through Sanctions Act (CAATSA), which was enacted to hold Russia accountable for its malign behaviour," they said. CAATSA's provisions, including sanctions targeting Russia's defence and intelligence sectors, serve as an important tool for the US government to discourage Russian arms purchases around the world. "However, in the case of this current S-400 transaction involving India, we believe that the application of CAATSA sanctions could have a deleterious effect on a strategic partnership with India, while at the same time, not achieve the intended purpose of deterring Russian arms sales," the two Senators argued. Warner and Cornyn said that the Congress established criteria for determining the appropriateness of waiving CAATSA sanctions. Specifically, the Fiscal Year 2019 National Defence Authorisation Act allows the President to issue a waiver if doing so is in the national interest, and if it would not endanger US national security, adversely affect US military operations, or compromise US defence systems. "We believe that a waiver for India is appropriate for several reasons," they argued. "First, India has taken significant steps to reduce its imports of Russian military hardware in recent years. From 2016 to 2020, there was a 53 per cent drop in Russian arms exports to India compared to the preceding five-year period," the letter said. "Meanwhile, India has shown its intent to purchase equipment from the United States, with sales reaching USD 3.4 billion in FY20. These are positive trends that show India's effort to reduce reliance on Russian equipment, and a desire to take advantage of its new status as a Strategic Trade Authorization-1 (STA-1) partner," they wrote. "Second, we believe there is a national security imperative to waiving sanctions. Imposing sanctions at this time could derail deepening cooperation with India across all aspects of our bilateral relationship - from vaccines to defence cooperation, from energy strategy to technology sharing," they said. "Furthermore, sanctions have the potential to embolden critics within India who warn that the United States will not be a consistent and reliable partner for cooperation, and to thwart the Indian government's efforts and long-term strategy to reduce Russian purchases and reliance on Russian defence hardware," the two senators wrote. "We share your concerns regarding the purchase and the continued Indian integration of Russian equipment, even with these declining sales. We would encourage your administration to continue reinforcing this concern to Indian officials, and engaging with them constructively to continue supporting alternatives to their purchasing Russian equipment," they said. "We also propose that your administration establish a bilateral working group to identify ways to promote the security of U.S. technology, and to chart a path forward to develop strategies to enhance U.S.-India military interoperability. We believe these actions reinforce India's status as a Major Defense Partner and will provide another avenue to counter PRC influence in the Indo-Pacific," the two Senators wrote.

Centre cites Sinho Panel note to defend EWS cap
The Centre has defended the Rs 8 lakh annual income criteria for the 10% economically weaker section (EWS) quota in Supreme Court, by citing the still undisclosed Sinho Commission report which specifically mentioned that the income criteria used to determine the OBC creamy layer "could well serve to decide the upper limit" for identifying the EWS among general category.In a 15-page affidavit filed on Tuesday - after the Supreme Court (SC) questioned the logic behind arriving at the annual income ceiling of Rs 8 lakh - the Centre has relied primarily on the Sinho Commission report but has also said that it is not the 'sole basis' for determining the income ceiling.While it had also cited the report while passing the law in Parliament, its affidavit now has pointed to other exclusionary elements from its 2019 office memorandum. 87288808These include land holding, house ownership, coverage by existing welfare schemes and assets, among others to identify deserving beneficiaries of the EWS quota.The key citation on income criteria, however, is from pages 97, 98 of the report of the Sinho Commission."This commission had, by its report of July, 2010, arrived at various conclusions including that the criteria to identify 'Creamy Layer' amongst OBCs could well serve as a basis to decide the upper limit or as a criterion for identifying economically backward class (EBC) amongst the general category as well", says the Centre's affidavit.It further adds that the commission did offer alternative income criterion as well.It recommended that "below poverty line (BPL) families from the general category, whose annual family income from all sources is below the taxable limit (as may be revised from time to time), may be identified as EBCs".The Centre, however, adds that although the Sinho Commission report is one of the aspects taken into consideration, the income criteria now fixed is not 'the sole basis' for determining the income criteria but the result of 'serious consideration that had already taken place to determine the criteria in the context of OBCs'."The exercise conducted to determine the Creamy Layer for the purpose of OBC reservation would be equally applicable for determination of EWS category since the fundamental premise is that that if a person/his family have a substantial economic standing, he/she may not require the benefits of reservation at the cost of others", it has said in the affidavit. 87288838It has held that the principle of fixation of Rs 8 lakhs as a criterion for determination of EWS as also for determination of Creamy Layer in the OBC category is 'rational and in keeping with Articles 14, 15 and 16 of the Constitution'. PSUs and pvt firms to compete for rail contracts
The Railway Board has issued an order that will now make public sector companies, including those under the national transporter, compete with the private sector in the open market for rail contracts. The order on Tuesday, in effect, takes away a level of protection the PSUs enjoyed under a policy formed in 2019 which gave them dibs at juicy rail contracts. Sources indicate that the decision taken by Railway Minister Ashwini Kumar aims to cut down on paybacks, bring in more competition and thus lower the Railways' cost. "The policy approved by the Board, in their meeting held on 19.12.2019 to introduce competition amongst the PSUs for awarding Railway works, hereby stands withdrawn with immediate effect," the order stated. Under the earlier policy introduced in 2019, the Railways identified eligible PSUs and awarded the contract after a competition within them. The winning PSU would then float tenders for contractors for the works. The Tuesday order said, "To further enhance benefit from competitive bidding, it has now been proposed to withdraw the policy for competition among eligible PSUs for allotment of work by Railway Board and the same shall now on be done through open tendering with immediate effect." "Also, all such works awarded to PSUs under existing scheme for which LOA (letter of award) has not been issued or MoU signed or no major contractual obligation undertaken in any form, will also stand cancelled with immediate effect," it stated. Under the new policy, the zonal railways will float tenders in the market and the contract would be awarded to whosoever wins the bid -- a PSU or any other company. "This in effect cuts out a layer in the process which will save both time and money. It also will weed out corruption and even monopoly of certain groups," an official said.

Online backlash makes companies revisit brand strategy
Strong social media reactions shaped by factors such as festivals, ceremonies, religious beliefs and local customs are forcing brands and companies to revisit their product and marketing strategies in India. Story-telling techniques for product marketing and brands could take a beating for certain categories as a result and devising post-campaign response strategies is getting all the more critical now, marketers, advertisers and consultants said. Some felt the brand campaigns should be better managed and more "thought through" considering the reach of the digital mediums. Ceat Tyres, Dabur, Tata Cliq and Fabindia are among the latest in a line of brands to have received online backlash for their ad campaigns. Subhash Kamath, chairman of the board of governors of industry watchdog Advertising Standards Council of India (ASCI), said the ASCI has very well-established codes in place for a long time, and he does not see the need to create any specific guidelines for categories such as festival ads. Industry insiders expressed concerns about the rising online discontent concerning brand campaigns. "Currently, adverse social media reactions shaped by religious beliefs are forcing brands to revisit their product and marketing strategies. Somewhere it will affect the motivation for the next round of communication based on the backlash received. The story telling might take a beating for a certain genre of advertisers," said Amit Tripathi, MD of independent digital-first agency IdeateLabs. Varun Duggirala, co-founder and content chief at The Glitch, a WPP agency which has worked with companies such as Hindustan Unilever, Netflix, LinkedIn and Diageo, said the developments will lead to a lot more planning for response management post campaigns now. "How will brands respond to the negative comments and the narrative after the ads, there will be a lot more focus on that now. Brands will have to increasingly plan for the reactions before they go live," he added.Ahmed Aftab Naqvi, CEO and co-founder of Gozoop Group, an independent advertising group across India and the Middle East, said it is unfortunate that there is a sharp rise in cancel culture and cyber bullying but brands are also equally responsible. Naqvi said some brands seem to be taking campaigns "too lightly" and are not thinking through enough. "Another reason could be to think of your customers only and not the larger audience which consumes your content which is not the right approach when it comes to digital," he added. Brand strategy expert Harish Bijoor concurred. "Most brands getting into trouble are the brands trying something different or woke. I think India as a market is too early for woke. When you try to push niche arguments to the masses, it will never win. It will take a niche channel to percolate it. This is where brands advertising for same-sex Karvachauth or no crackers on the streets fail ... the norm is crackers on the streets," he added. Fabindia pulled down its jashn-e-riwaz promo after severe online backlash recently. Consumer goods maker Dabur India apologised for its latest ad on Fem bleach which showed a same-sex couple fasting for each other on the festival of Karvachauth. While many social media users said they appreciate the ad for being inclusive and progressive, an equally large number of people said the ad was against the festival and hurt their religious sentiments. Some also equated the ad to promoting fair skin. "Our intention is not to offend any beliefs, customs and traditions, religious or otherwise. If we have hurt the sentiments of any individual or group, it was unintentional, and we apologise," Dabur posted on its twitter handle. A Tata Cliq festive ad drew the ire of some users who complained about the models in the ad not wearing bindi and wearing green outfits. Users called for boycotting Ceat Tyres following an Aamir Khan ad which urged users to not burst crackers on the roads.

Power units need 10 MT imported coal this fiscal
Indian power plants require 10 million tonnes of imported coal in the current financial year to build stock at the stations that can last through next summer, though the coal ministry is confident that next year onwards it will be in a position to export coal.Power plants need 40 million tonnes of domestic coal for adequate stocks which need to be built starting October, according to the Central Electricity Authority (CEA).As per CEA's assessment, the 10 million tonnes are required to make up for the generation loss due to non-operalisation of 17 GW that are dependent completely on imported coal, priced at $160 per tonne currently.87264697Industry experts expect international coal prices to remain high for a few more months. CEA has laid out a month-wise coal requirement plan by power stations in preparation for the summer months.As per the estimates a total 398 million tonnes of domestic coal is required by the power plants, including for building 40 million tonnes inventory. Another 10 million tonnes is required to meet 30% shortfall electricity generation so far by the imported coal-based units.While Coal India is expected to meet 338 million tonnes, the captive coal mines are expected to produce 40 million tonnes and Singareni Collieries Company Ltd (SCCL) another 30 million tonnes.The power industry is not very confident of domestic coal companies being able to meet the targets. State-run NTPC and DVC have floated tenders seeking two million tonnes imported coal following a directive by the power ministry asking companies to use it for blending purposes to meet a shortfall in domestic coal. However, the coal ministry is upbeat about exporting coal by mid-next fiscal year.According to a top coal ministry official, domestic coal production will be upwards of 900 million tonnes in the next financial year including about 100 million tonnes from captives and 75 million from SCCL and the balance 725 million tonnes from CIL against around 700 million tonnes in FY21.Amid the coal stock crisis at plants, power companies alleged Coal India was 9% short of its production targets and 18% less than despatch targets during the period between April-September this year.The official said CIL had a record 99 million tonnes stock on April 1 this year, forcing the company to lower its production. "In July-September CIL has done record production and offtake. When Gencos were not lifting what happens to the target? What is material is CIL has the coal to supply," he said.India is in the grip of a power crisis with plants running low on fuel as demand rose while rains hit domestic coal supplies and costly imported fuel rendered nearly 18 GW capacity unviable.Data available till October 24 showed that plants of 165-GW monitored power capacity had five days of average coal stock. Nearly 76 Gw of the capacity was operating on coal stock of less than four days.

View: Why India needs to look at green hydrogen
India's current energy import bill is over $160 billion (Rs 12 lakh crore) a year. The continued coal and oil dependency will increase this amount 2-3 times, apart from pushing the country to the brink of an environmental catastrophe. Consumers, and some governments across the world, are demanding for more sustainable products. This trend will only intensify and will become less of an opt-in and more of 'table-stakes'.So, for strong economic and exports growth, India has to develop and sell zero- or negative-carbon footprint products. While other major economies spend trillions to decarbonise, India can grow in a carbon-neutral manner. These energy transition technologies include solar, wind, batteries, power electronics and, the latest option, green hydrogen.Green hydrogen (GH) is hydrogen produced by the electrolysis of water using electricity from renewable energy (RE) sources, such as solar and wind. GH has come to the forefront of decarbonisation, since it is a non-fossil fuel-based clean gas that can substitute fossil fuels, especially where electrification is not a viable option. With no country dominating the GH space yet, India has a big opportunity to become a leader in GH deployment and production.The announcement of the National Hydrogen Mission (NHM) on August 15, 2021, is a statement of intent India must now capitalise on. GH can compete with oil today. Hydrogen fuel cell-based trucks would be more fuel-efficient, more economical, and a real alternative to diesel even today.India needs to act in multiple directions to establish itself as a GH hub. Immediate policy initiatives are needed to create demand for GH. Providing incentives and sectorial targets for this fuel can kickstart the industry. Some potential policy interventions for demand creation include integration of GH targets with the existing Perform, Achieve and Trade (PAT) scheme, and implementation of GH purchase obligation for industries. A long-term policy roadmap is also required to decarbonise other sectors such as steel and fertilisers.There should be support for creating an integrated domestic manufacturing ecosystem for GH. Domestic electrolyser manufacturing, R&D support for power electronics and other parts of the supply chain need to be promoted. This can facilitate high levels of indigenisation across the supply chain.Hydrogen production would require cheap renewable electricity, which accounts for roughly 50% of the levelised cost of hydrogen (LCOH). Solar and wind energy in lowest possible tariffs is necessary to make the cost of GH viable for the transition. To facilitate this, dollar-denominated tariffs for solar and wind can be created to bring cheaper foreign equity as well as debt.Finally, a potential Achilles' heel for hydrogen is in its handling and transportation. Hence, a framework for a power transmission superhighway with concessional transmission costs for green power should be created. Essentially, we should produce solar and wind power, where it can, at the lowest cost, transmit the power to where hydrogen is required locally. This would reduce handling cost, increase flexibility in ramping-up hydrogen adoption and eliminate 'natural monopolies' from taking over. The superhighway will enable hundreds of businesses to take part in the hydrogen economy.In line with the above principles, a National Green Hydrogen Mission (NGHM) can create an ecosystem that supports rapid adoption of GH. With the requirement of over 10 ministries to cohesively collaborate, NGHM would bring various ministries, concerned public sector undertakings (PSUs) and other stakeholders on board for India to achieve energy independence. If India can emerge as a global hub of GH, it will attract investments, provide solutions and gain strong global support from other economies for addressing the problem of climate change.Climate change is a global problem and any company that comes forward to support India will see the most timely and effective use of their dollars spent to abate climate change. In the quest to become a GH leader, India needs to rapidly scale up its hydrogen equipment industry and pioneer the transition of various applications to GH. While developed countries may take longer in transitioning to GH by building new infrastructure or retrofitting existing facilities, they would most likely invest in India for ecological conservation and business objectives.If India can just do it right in the first go, it will significantly leapfrog to become a global economic leader, and one to do it in a sustainable way.The writer is investor, Ohmium
