The Supreme Court on Thursday refused to refer to a larger bench the issue of whether a 1994 ruling holding that mosques are not necessary for practice of Islam, a ruling the Muslim parties to the Ayodhya title suit said prejudiced their claim. The Ayodhya case will be heard from October 29, the Supreme Court said.The issue had cropped up when a three-judge bench headed by Chief Justice Dipak Misra was hearing the batch of appeals filed against the Allahabad High Court's 2010 verdict by which the disputed land on the Ram Janmabhoomi-Babri Masjid area was divided in three parts.Justice Ashok Bhushan who read out the majority verdict said the Civil suit has to be decided on basis of evidence and previous verdict has no relevance. Justice SA Nazeer disagreed with CJI and Justice Bhushan.Both the sunni central wakf board and the nirmohi akhara have appealed to the top court against the judgement. In its preliminary arguments the Muslim parties led by senior advocate Rajeev Dhavan had urged the court to revisit the Ismail Farooqui judgment as it prejudices their claims over the structure.The land under the dome has gone to the hindus. The top court today in a ruling 2:1 refused to have the 1994 ruling referred to a larger bench. But justice Abdul s. Nazeer disagreed but said that it was too late to complain about the ruling. CJI Dipak Misra and Ashok Bhushan refused to refer the issue to larger bench. The majority also spoke of all religions peacefully coexisting. "All religions are not incompatible but complementary."
